1. Data Collection, Purpose & Lawful Basis

We collect personal, business and technical data (e.g., name, email, business details, device & usage data) only for explicit business purposes — service delivery, billing, support, marketing with consent, compliance and fraud prevention. Processing is based on consent, contract necessity, legitimate interest or legal obligations where applicable.

2. Cookies, Tracking & Consent

We use essential, performance, functional and marketing cookies. Non-essential cookies are activated only after user consent. Users can manage cookie preferences through the consent banner, browser settings, or account preferences.

3. User Rights — Access, Correction, Deletion & Portability

Subject to applicable laws (GDPR, CCPA, DPDP), users can request access, rectification, deletion, portability, objection to processing, and consent withdrawal. Requests are handled promptly following verification.

4. Child Data Protection (COPPA / DPDP aligned)

We do not knowingly collect personal data from children under 13. If a parent believes their child’s data was collected, contact us immediately and we will promptly remove such data.

5. Data Processing & Security Compliance

We implement technical and organizational safeguards — encryption in transit, access controls, backups, role-based access, and regular audits. Subprocessors are vetted and bound by security and confidentiality obligations.

6. Cross-Border Transfers & Sub-processors

Personal data may be transferred to service providers in other jurisdictions under adequate safeguards (SCCs, contracts). We maintain a list of subprocessors and notify customers of material changes.

7. Data Retention, Archival & Deletion

We retain personal data only as long as required for business, legal or contractual obligations. Data may be anonymized for analytics. Deletion requests are honored subject to legal retention requirements.

8. Payment Processing & Financial Data

We use PCI-compliant third-party payment processors. CJDMS does not store full card data. Billing, tax, and audit records are kept as required by law.

9. Refunds, Cancellations & Trial Policies

Digital goods, SaaS subscriptions and franchise/licensing fees are generally non-refundable unless otherwise specified. Cancellation procedures, trial terms and duplicate/unauthorized charge remediation are documented in the refund policy.

10. SaaS Licensing, Account Security & User Obligations

SaaS access is licensed (not sold). Account holders must protect credentials; they are responsible for activity originating from their accounts. License terms, suspension and termination rights are laid out in the Terms & Conditions and SLA.

11. Service Levels, Uptime Guarantees & Support Response

CJDMS targets published uptime for hosted services and provides tiered support with defined response and resolution targets. Remedies for SLA failures (e.g., service credits) are specified in the SLA document.

12. Third-Party Services, Integrations & Limitations of Liability

Integrations with third-party platforms (ads, email, payment gateways, analytics) are subject to their terms. CJDMS disclaims liability for third-party failures beyond its control; overall liability is limited as stated in the Terms & Conditions.

13. Intellectual Property, White-Label & Resell (RWF) Rules

All IP remains the property of CJDMS. Resellers, white-label and franchise partners receive limited, revocable rights per agreement. Branding, marketing and reseller conduct must comply with the RWF Policy and any executed partner agreement.

14. Franchise Rights, Fees, Territory & Compliance

Franchise grants (if any) are documented in Franchise Agreements and the Franchise Master Agreement. Franchisees must comply with territorial, operational, fee and brand-use rules and are subject to audits and performance KPIs.

15. Marketing Communications & CAN-SPAM / Opt-Out Rights

All commercial messages include clear identification and opt-out mechanisms. We comply with CAN-SPAM and national spam laws. Users can opt-out anytime via the unsubscribe link or contact addresses.

16. Termination, Suspension & Post-Term Obligations

CJDMS may suspend or terminate access on breach, non-payment, illegal activity or security risk. Post-termination obligations include data handover, removal of branding, and payment of outstanding fees as per the applicable policy/agreement.

17. Limitation of Liability & Indemnification

To the maximum extent permitted by law, liability is limited (commonly to fees paid in a defined period). Customers and partners agree to indemnify CJDMS for third-party claims arising from their misuse or breach of contract.

18. Governing Law, Jurisdiction & Dispute Resolution

All policies and agreements are governed by the laws of India with exclusive jurisdiction in Bhuj (Kachchh), Gujarat, unless a separate agreement specifies an alternative dispute resolution mechanism.

19. Policy Changes, Notifications & Effective Date

Policies may be updated; changes are effective upon posting with an updated effective date. Significant changes will be communicated via email to registered accounts where required by law.
